Let's Get Hot Prize Partner Agreement

This agreement is between the business named on your Let's Get Hot business account (the "Partner") and CriaLabs LLC, which runs Let's Get Hot (the "Company"). The Company is the sponsor and administrator of every giveaway. The Partner provides a prize and is not a sponsor.

The person accepting confirms they may bind the Partner to it. Either side may end it by email; giveaways already open run to their end under it.

For each giveaway the Partner names the prize, its retail value in US dollars, how it reaches the winner (a gift card the Company buys with money the Partner prepays, a code for the Partner’s own goods, shipped by the Partner, or picked up at the Partner) and, for a shipped or picked-up prize, where it comes from.

The prize is in the Company’s hands before anyone can enter: a code is given to the Company when the giveaway is created, and a gift card is prepaid. A prize the Partner ships or hands over is promised by this agreement, and the Partner keeps it available until the winner has it.

A shipped prize is sent within 30 days of the winner’s claim, with a tracking number entered in the Partner’s dashboard. A picked-up prize is held for 30 days from the claim and handed over against the one-time code and the winner’s ID.

If a prize has not been delivered within those 30 days, the Company may give the winner a substitute of equal value and charge its cost to the Partner, and the Partner takes a strike. A second strike closes the account.

No alcohol or anything redeemable for it, tobacco or vape products, cannabis including hemp THC and CBD, firearms or weapons, gambling or lottery products, prescription or medical products, adult products, live animals, cash, or supplements.

Entry is free and decided by the giveaway’s published rules. The Partner never asks an entrant or a winner to post, review, follow, buy, visit or sign up for anything as a condition of entering or winning, and never says a prize was won for any reason the rules do not state.

The Partner makes no health claim about its business, its products or the prize anywhere in the app or about a giveaway.

For a shipped prize the Partner receives the winner’s name, address and phone number, and only after the winner has agreed to it on the claim page. The Partner uses them to deliver the prize and for nothing else: no marketing, no mailing list, no sharing, unless the winner separately agrees to it with the Partner. The Partner deletes them once the prize is delivered and any dispute is settled.

The Partner never receives any member’s steps, health information, standing or location.

The Company issues any tax form the law requires a sponsor to issue to a winner. Each side pays its own taxes, and the Partner pays any sales tax on a prize it ships or hands over.

The Partner is responsible for its prize, its delivery and what it says about a giveaway, and will defend and cover the Company against claims arising from them. The Company is responsible for running the giveaway under its rules, and will defend and cover the Partner against claims arising from that.
